Not often. Although in Scottish Law a lot of things that cost money (Reports, Court Dues etc.) cannot be charged as there are two forms of charges in Scottish Litigation. Agent/Client and Party/Party. Everything that is chargeable in Party/Party is also charged at Agent/Client, although the Client doesn't see these charges as the other party pays for them. Unfortunately not everything that is Agent/Client is chargeable in Party/Party account. Of course, there is also no expenses due to or by either Party, which means each side bear their own costs... which I doubt MFC/Boyle would have accepted. It is very unusual to end in debt if you are the Pursuer and win your case unless your solicitor fucked up a couple of times during the proceedings (missed deadlines, extra unnecessary Motions etc.)
We could, like Steelboy says pay the Solicitor now (Harper McLeod I believe *spit*) and reveive the money back once the Party/Party Account is paid up.
