SPL drops Hearts charge Tynecastle club keen to move on after wage dispute Last Updated: January 27, 2012 3:14pm Tynecastle: Hearts are 'satisfied' with the outcome of SPL's decision The Scottish Premier League has decided to drop its charge against Hearts for an alleged breach of rules. Earlier in January, the Tynecastle club were charged with "failing to behave with the utmost good faith" over the delayed payment of player wages. However, a statement from the SPL on Friday confirmed: "The Scottish Premier League today announced that the charge against Heart of Midlothian FC for an alleged breach of SPL Rule A3.1 has been dismissed." Hearts were charged after the SPL announced that wages were delivered late for a fourth successive month. The claims were refuted by the Jambos, who insisted they had "documentary evidence" to confirm salaries of players and staff, including manager Paulo Sergio, were paid on time for the first time since September. Hearts have now escaped possible punishment after the SPL accepted they were "acting in good faith" by instructing their bank to make the payments on 16th January, even though funds did not reach players' bank accounts until the following morning. Payment The SPL statement continued: "An SPL Board sub-committee determined that for the club to have complied with the order of 4th January, it had to have the players' wages in the players' bank accounts and available for their use by not later than midnight on 16th January. "In fact the wages did not reach the players' bank accounts until the morning of 17th January. "However, the SPL Board sub-committee found that the club's directors believed that, by irrevocably instructing their bank on 16th January, that was sufficient to make payment and comply with the order. "Because the club's directors believed that they were complying with the order, Heart of Midlothian were acting in good faith. Accordingly the charge against the club was dismissed." Responding to the news, a Hearts spokesperson said: "We are satisfied at today's outcome. "Both the SPL and ourselves worked constructively to assess the circumstances that led to the hearing and we can now move on having resolved the situation. I hope this escalates and we ban the media from FP then they will have nothing to run to the compliance officer with. 2 simple points Mr Broadfoot (and i'm trying my best to remain polite) If the referee sees it its a yellow card and not a ban, so is the ref at fault ? cause he hardly tried to hide what he was doing ? Also as this is now an SFA rule will there be cameras at every single SFA game or is it just the spl players that are being punished ? No wonder fans are so distrusting of the media when this cannot be anything other than trial by TV.

The English FA's first ever compliance officer has crossed the divide and now fights FOR stars who have been hit with disciplinary charges. His company Football Factors does work for top Premier League sides including Manchester United, Liverpool, Everton and Bolton. He's willing to scrap the £175 an hour his company normally charge to take on a case up here for FREE. Former cop Bean put that proposal to St Mirren when skipper Jim Goodwin was hit with a two-match ban for lashing out at Steve Jennings after being clawed by the Motherwell man on Saturday. He says he's still waiting for a reply, while Motherwell's appeal against Jennings' ban today is likely to come too soon for his help. That won't stop Barnsley-based Bean, 50, in his pursuit to help players get off the hook. He said: "These complaints from clubs are ones I'm all too familiar with. It's down to consistency and it sounds to me that the SFA's system lacks that. "We are very keen to break into the Scottish market and I had emailed St Mirren offering them our services free of charge. "I wanted to let them give us a chance to show what we can do.All we'd asked for was travelling expenses which would probably have been a couple of hundred quid. "We never got a reply back and I plan to speak to Motherwell to see if I can help out in a similar way." Vincent Lunny became the SFA's first compliance officer in October. It was the key role in chief executive Stewart Regan's revolutionised regime after a controversial season dominated more by legal speak than by football talk. Bean took up the same role with the FA 12 years ago. In his four years he dealt with high-profile cases involving the likes of David Beckham, Patrick Viera, Robbie Fowler and Paolo di Canio. He quit in 2003 amid rumours he wasn't given the support by the FA to carry out the job he wanted. It was one of the reasons he feared for the new Hampden setup when he spoke to SunSport in the summer before Lunny's appointment. Now he claims it was a mistake to turn to the former war crimes prosecutor because of his lack of experience in the game. Bean said: "I never played the game professionally but I did have experience working in football. "I worked on the football task force and was also chairman of the Football Supporters Association. "Through that I understood the workings of football and knew administrators and other people behind the scenes. "That gave me a head start.While I don't know Vincent Lunny's pedigree, his CV shows he's done a lot of work with war crimes. I'm sure he did a very good job at that but it's not exactly the right way forward if you're wanting football to take you seriously in terms of governance." Bean is adamant more than one person is required to carry out Lunny's role and reckons the SFA should look at the way the English system has evolved since he left. He also believes things could still be improved down south. He said: "When I started, the FA had a very similar set up to the way the SFA are running things, but we quickly turned it around. I got taken out of the decision-making process and we had a video panel who'd decide whether a charge should be issued or not. "I actually think the model the FA use now is an even better one. "While Scottish football is a smaller set up than England, one guy can't do that job on his own. "He needs a team around him with specific jobs simply so he's not overladen with the work. "That was the problem when I first went into the job. You just weren't able to give everything and everyone your undivided attention. "That's why the FA brought in these other investigative individuals to develop it in that way. It's just not a job for one." There is an independent three-man judicial panel which rules on any appeals in Scotland — but Bean said: "How can that be when they're brought in by the SFA? "It should be completely independent individuals."

Strange how the cameras missed last nights sending off. That was an important and game changing moment, isn't that what this was set up for ? Instead we have over scrutiny of gestures FFS i remember Cooper giving the bird to the Celtic fans behind his back standing next to the linesman while waiting to take a throw in. This type of thing has went on for Years and there's a lot more wrong with the game than wasting time on such trivialities.

I was actually for this when it first came out as I was of the understanding it was for serious offences that had been missed. It now seems that every single triviality is now up for instant bans. I Find it vastly unfair that the person charged with enforcing the rules is not under the same scrutiny. Also did they not try the same model as us in England and end up scraping it as it simply didnt work ?

Motherwell challenge one-match ban facing Michael Higdon Higdon hit a late equaliser for Motherwell at Tannadice on Saturday Michael Higdon is facing a one-match suspension for a gesture made during Saturday's draw at Tannadice - but Motherwell will challenge the decision. The striker has been offered the ban by Scottish Football Association compliance officer Vincent Lunny. Higdon has been accused of gesturing at his club's own fans after scoring in the 1-1 draw with Dundee United. "The club will lodge the official appeal before 3pm tomorrow," Motherwell announced on their website. "At which point the matter will be referred to the judicial panel with a fast track tribunal convened on Thursday, 26 January. "The club will make no further comment until after that process has been complete." However, 24 hourse earlier, manager Stuart McCall warned against "trial by Sportscene", questioning whether the compliance officer was making decisions from his own viewing of matches or from what is shown on BBC Scotland's Scottish Premier League highlights programme. If you actually watch it, it's a half-hearted gesture, it's not with any malice, there's no swearing coming out of his mouth, he's not angry with anyone Stuart McCall Motherwell manager And he claims the "half-hearted" act was not aimed at the Motherwell support and that there was no malice in the incident. "It was highlighted in the TV programme and a couple of media guys have mentioned it," said McCall. "But there is no way in a million years it's comparable to what's gone on beforehand. "I think it was a non-entity and it's not even worth talking about if I'm being honest." Hibernian striker Leigh Griffiths has received one ban and has appealed against another already this season for making gestures during games against Rangers and Cowdenbeath. Asked if he believes too many incidents are now being looked at since the introduction of the SFA's new disciplinary procedures, McCall said: "I think so. "I think you've got to look at it and say that, because you could spend another 10 seconds on the build-up to the goal, the link play, the movement, rather than showing a half-hearted gesture. "It's more about looking at digging up dirt if you like than showing the positive side of it. "For me, it was nothing. I've seen incidents since I've been a kid and you'd look at things and go 'that's bad' or 'he can't get away with that'. "Higdon's thing was nothing."

Yep and ive had a few barnies telling folk to give it a rest as my kids are there. 1 ginger twat in particular told me its the chance I take bringing my kids to the football. I could have smacked the cheeky c**t. Instead I asked him if hed walk down the street cursing away and if he would do it infront of the police as he thought it was so acceptable. I can see Randolphs point but when he steamed in he lost my sympathy.

While i agree abusing our own players isn't constructive, i can see why he may have done it. We all agree it was a shit performance today and paying punters WILL get frustrated at players seemingly taking the wages and not being too bothered about being beaten. I started a thread a while ago about the lack of dig i felt in this team. The guy may have been out of order i was other side of the cooper and missed most of it but if going by this forum and the guy called him a dick or prick near the end of a game we were totally crap in, the i fully understand his frustration. For Randolph to want to square go the guy shows a loss of professionalism IMO (tin hat on) really he should be embarrassed at the result then again for his dummy out the pram attitude You take a bit of stick as a footballer, you cant have everyone singing you're name when your wonderful then not expect shit when you're crap by him i mean the entire team. And before anyone says im defending the guy abusing him IM NOT. i just think Randolph totally lost his professionalism.

Pish performance dire home statistics. Higdon i feel sorry for him why is Mccall so intent playing him as an assist striker when we have no nippy forwards to latch onto his flicks? Murphy is best wide cutting in and attacking but seems to be restricted to doing what he does best? Daley tries hard but isn't really that good and Humphrey's flatters to deceive great pace sod all end product. Hatley ffs stop trying to score from corners you may get 1 but Christ you're wasting hundred's before it, 8 corners today and i cant remember a real threat on target from any of them. Nicky law lets be fair and just say it wasn't a great game. Don't want to go over the top with ever single player and be over critical but i feel these are the ones that can win us games and the points i have mentioned need to be addressed. Or we can just forget Europe right now. The players said they wanted to put recent performances right and were itching to do so (forget the queens game that doesn't count) I sure as fuk didn't see that in the players today as we were out fought out thought and out played we deserved fuck all. The sign of a great team is not what they win but how high they can bounce back after defeat. Please prove me wrong?

I cant believe some of the comments on here? (wait a min its a Motherwell forum). We took an early lead then added to it and sat back a bit. We were playing a team with nothing to lose and predictably they threw everything at is but the gulf in class ensured we were never really under any real threat as we always had another gear to step up into if required. The judgment of the younger players is very harsh (there's a lot more to match fitness than fitness). 4-0 yes it flattered us slightly but hey ho job done and as i said i always felt we had another gear if required very much like the Dunfermline away game. Job done and through so relax a bit folks.

I'm desperate for us to come out raring to go and trying to kill the game as quickly as possible (not just cause i have a bet on a goal in the first 15) but because it will calm nerves and make for a better game where players can truly show the gulf in class. I HOPE
